In consideration of participating in HAUNTED ACTIVITY ENTERTAINMENT ESCAPE ROOMS ACTIVITIES; hereby agree to release and discharge from liability arising from negligence HAUNTED ACTIVITY ENTERTAINMENT (Room Name 1 -Room Name 2- Room Name 3- ….) and its owners, directors, officers, employees, agents, volunteers, and all other persons or entities acting for them (hereinafter “Releasees”) on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:

1- I acknowledge that these activities involve known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to broken bones, bruises and other bodily injuries caused by falls or contact with walls, objects, or other participants; medical conditions resulting from physical activity; damaged clothing or other property, coming in contact or contracting the Covid-19 virus or any other viruses. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.

2- acknowledge that the nature of the activities is not suitable for pregnant women or people with medical conditions including but not limited to heart conditions, asthma, anxiety disorders, PTSD, lights or sound sensitivity and I shall Indemnify and hold the Releasees harmless for any injuries associated with participating at my own risk and responsibility.

3- I expressly accept and assume all the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that i am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.

4- I expressly accept and assume all the risks inherent in this activity or that might have been caused by the negligence of the Releasees known that this activity is in a group setting and that I may come in contact or contract the Covid-19 virus or any other viruses. My participation in this activity is purely voluntary and I elect to participate and release any liability from the Releasees despite the risks

5- I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

6- I represent that I have adequate insurance to cover any injury or damage I suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume- and bear the costs of- all risks that may be created, directly or indirectly, by any such condition.

7- I agree to observe all posted rules and warnings and to follow any oral instructions or directions given by the Releasees.

8- I agree to be liable for any damages to HAUNTED ACTIVITY Entertainment escape rooms facilities arising from my negligent, reckless, or willful conduct.

9- I hereby grant permission to HAUNTED ACTIVITY Entertainment escape rooms the right of my image or video without payment or any other consideration. I understand that my image may be edited, published, or distributed for marketing purposes and waive the right to any royalties or other compensation arising from the use of my image or video.

10- I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

11- I fully understand that there are no refunds under any conditions once I purchase my entrance fee.

12- This Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

WHEN REGISTERING ONLINE, MY ONLINE SIGNATURE SHALL SUBSTITUTE FOR AND HAVE THE SAME LEGAL EFFECT AS IF I HAD SIGNED A PHYSICAL AGREEMENT.
